Avocado Estates is a single-family home HOA in Carlsbad, CA. These rules apply to all owners, residents, tenants, and guests. This handbook supplements the main Declaration of Restrictions and Bylaws. It details what living here requires—from property upkeep and pets to parking and fines.
- Leasing & rentals: Homes must be used as private residences. Short-term rentals under 30 days are prohibited. Owners may not rent out more than one room. All leases must follow the Declaration, and owners must report tenant names to the property manager within 10 days.
- Pets: Only ordinary household pets (dogs, cats, fish, birds) allowed, not for commercial breeding. Dogs must be on a leash 6 feet or shorter when outside. Owners must immediately clean up pet waste. The board can require removal of a pet that is a nuisance or threat.
- Parking & vehicles: No RVs, boats, trailers, or commercial trucks visible from common areas or other lots (overnight parking in driveways requires board approval). Inoperable vehicles must be in a garage. No street parking; guest parking in designated bays. Speed limit 15 mph. Vehicles left over 72 hours in common areas may be towed.
- Architectural changes: Any exterior change—paint, fencing, landscaping, solar panels, etc.—requires written board approval. Changes must match the existing character. Unapproved additions may be removed at the owner’s expense.
- Property maintenance: Each lot must be kept neat and clean: no visible weeds, debris, or trash. Trash bins may be set out only the evening before pickup and must be stored the morning after. Window coverings can’t be foil or towels. No hanging laundry on fences or decks.
- Fines & enforcement: Fines start at $50–$150 per offense, with higher fines for repeated or tree-related violations. Fines can increase by $50 increments for continuing violations. Four or more violations in six months may result in an additional $1,000 fine. The board follows a notice-and-hearing process before imposing monetary penalties.
- Common areas (pool & pond): The pool is seasonal (March–Thanksgiving), open 9 a.m.–10 p.m. (lap swim 6–9 a.m.). No lifeguard; guests must be accompanied by a resident (max 5 guests unless a scheduled party, limited to 20 people for 3 hours). The pond is open sunrise to dusk for residents and guests; no swimming, wading, alcohol, or smoking; catch-and-release fishing only with barbless hooks and worms.
- Signs & flags: One for-sale sign allowed. Non-commercial signs and flags up to 9 square feet on private property; holiday signs may be displayed 30 days before and must be removed 14 days after. No signs on common areas. Flagpoles in the ground are not permitted.
