This is a partial document — a First Amendment to a master declaration for Hayden Ferry Lakeside East, a master-planned community in Tempe, AZ that includes multiple condominium associations. It primarily adds new property (Bridgeview) to the community and amends rules about parking, access control, and common areas. This is not a full rulebook for residents; the main rules are in the original Declaration and each condominium's own declaration.
- Community structure: The community has a Joint Committee that oversees shared common areas (like Lakeside Drive and underground parking) and individual Condominium Associations that manage each parcel. Each condominium's declaration governs its own units, but this amendment adds Bridgeview as a new condominium association within the same master community.
- Access & security: The founder may install gates, card readers, or guardhouses to limit access to Lakeside Drive and the community during the Development and Sale Period. After that, the Joint Committee can also do so with founder approval. Ingress/egress for residents and permitted visitors cannot unreasonably be restricted.
- Parking & underground facilities: The Underground Parking Facilities are shared by all condominium parcels. The founder has the right to assign specific parking spaces to particular condominium parcels until all spaces are assigned or the Development and Sale Period ends. Each Condominium Association can then assign those spaces to individual unit owners and enforce those assignments. The Board may reassign spaces to accommodate disabled persons, construction, or reconfiguration.
- Easement over Lakeside Drive: The founder reserves a perpetual easement for access over Lakeside Drive and can assign that right to third parties (e.g., adjoining property owners), subject to sharing maintenance costs. The Joint Committee may regulate use of Lakeside Drive but cannot treat third parties differently from condominium residents without a reasonable basis.
