Lindsay Park Townhomes is a community of single-family townhomes in Mesa, Arizona, governed by a homeowners association (HOA). The HOA maintains common areas and enforces rules that apply to all owners, residents, and tenants. The association has the authority to levy assessments, enforce architectural standards, and adopt rules for use of the property.
- Residential use & home businesses: Each residence is for single-family use only. A limited home business is allowed if it doesn't create noise, traffic, or visible signs from outside the unit, employs no non-resident workers, and complies with all other rules. Leasing your home is not considered a business.
- Architectural review: Any exterior change or improvement (including landscaping, fences, paint, or new structures) must be approved in writing by the Architectural Committee before work begins. The committee has broad discretion and may deny plans even if they comply with guidelines. If they don't respond within 45 days after complete submission, approval is not required.
- Parking & vehicles: Vehicles must be parked in the garage or driveway (if limited in size: max 7 ft high, 18 ft long, no commercial markings). Recreational vehicles and boats can park in a driveway only for loading/unloading—max 24 hours continuously or 72 hours per week. Inoperable vehicles visible from neighbors are prohibited, and the HOA can tow violators at the owner's expense.
- Pets & animals: You may keep up to two domestic dogs, cats, or similar household birds as pets. Dogs must be on a leash (max 6 ft) when off your lot, and owners must immediately clean up waste on common areas. The HOA may ban pets that are a nuisance, noisy, or dangerous.
- Leasing & rentals: You can lease your entire home (not part of it), but all leases must be in writing and for an initial term of at least one month. You must notify the HOA at least 10 days before the lease starts with tenant names, contact info, and emergency contact. You are responsible for any rule violations by your tenants. No subleasing or lease assignments allowed.
- Assessments & fees: Every lot pays an annual assessment set by the HOA board, billed quarterly (or as the board decides). Special assessments for major repairs or improvements require approval by 2/3 of member votes. Delinquent assessments incur interest, late fees, and a lien on the property that can be foreclosed.
- Common area & easements: All owners and residents have the right to use common areas (like streets, walkways, and recreation facilities), subject to HOA rules. The HOA can suspend use for those more than 15 days delinquent on assessments or for uncured violations. The HOA has access easements to inspect and maintain lots and common areas.
