Lake Wilderness is a large single-family-home HOA in Spotsylvania, VA, governed by its own Bylaws and a Declaration of Covenants (Deeds of Dedication). Members are lot owners (one vote per lot, regardless of number of owners), and the rules cover common areas, roads, architectural standards, and member conduct. Lessees have use privileges but no vote.
- Membership & voting: Only fee-simple lot owners are members, with one vote per lot. To vote or use common areas, an owner must be 'in good standing': current on all assessments, fines, and road fees, and not suspended. Owners may designate up to two individuals as members if a lot has more than two owners.
- Common area use & privileges: Members, their immediate family (spouse, significant other, children), and lessees (with their family) may use common areas. Guests above a Board-set number must pay a recreation fee. Members not in good standing cannot use common areas or vote. Lessees have no vote and cannot serve on the board.
- Leasing & rentals: Lessees and their immediate family are granted the same common-area privileges as owners in good standing, except they cannot vote or be board members. An owner who leases retains their own use and voting privileges as long as they remain in good standing.
- Architectural review: An Architectural and Environmental Control Committee (AECC) must approve all new construction, additions, and landscaping changes. The committee reviews design, placement, and environmental impact, and must respond within 30 days of a complete application. Construction must be completed within 6 months of approval. Tree removal of live trees 6 inches or more in diameter (3 inches near front lines) requires written permission. An impact fee applies to new homes, additions, or improvements.
- Roads & parking: Road maintenance is split: the HOA maintains certain entrance roads; lot owners in Sections I & IA and XII–XVI are responsible for their own roads (via a Roads Association or Committee); Sections II–XI have a Roads Committee that sets an annual road fee. Overnight parking on road rights-of-way requires written approval and a visible permit; unauthorized vehicles may be towed.
- Assessments & fees: Annual lot assessments are set by the Board and approved by members. Delinquent assessments become a lien on the property, bear interest at the legal rate, and incur collection costs and attorney’s fees. Special assessments may be levied with Board authority. Dues waivers are possible only for documented hardship and for a maximum of two years, requiring extensive financial disclosure.
- Pets & animals: Dogs must be leashed when off the owner's lot. Pets (except service dogs) are prohibited on beaches, in the pool area, on tennis courts, and in the clubhouse. 'Dangerous dogs' as defined by Virginia law are banned; the Board may ban any dog that creates an unreasonable risk of harm.
- Vehicles & traffic: State motor vehicle laws apply to all HOA roads. Posted speed limits must be obeyed. Only vehicles authorized by the Commonwealth may be driven on HOA roads. Violations may result in fines, and unpaid fines are treated as an assessment against the owner's lot.
