What Paradise Canyon Owners Association's governing documents say
Paradise Canyon is a planned unit development of townhomes in St. George, Utah. You own your lot (including the land beneath your home) and share ownership of common areas with other owners through the Paradise Canyon Owners Association. This document is the full rulebook — it tells you what you own, what the association maintains, what you can and can't do with your property, and what fees you'll owe.
- What you own & maintain: You own your lot in fee simple — that includes the land under your townhome and any area within your lot lines, even outside your walls. You are responsible for maintaining the exterior of your townhome and the limited common area right next to your lot. The association maintains the common areas, limited common areas not adjacent to a lot, and certain exterior areas of lots that are similar to surrounding common area.
- Assessments & fees: Every owner must pay annual assessments (initially capped at $1,500 per lot, can be increased up to 5% per year without a vote, or more with 67% owner approval), plus special assessments for capital improvements (requires 67% vote if no Class B member), and additional assessments for repairing damage from city utility work. Late payments incur 18% annual interest and up to a 10% late fee. Unpaid assessments become a lien on your lot, and the association can foreclose.
- Architectural review: You cannot build, add to, or change any exterior structure (including fences, walls, landscaping, or paint) without written approval from the Architectural Control Committee (or the trustees if no committee exists). Plans must be submitted and approved within 30 days, or approval is not required. Changing overall design standards requires 67% owner vote.
- Use restrictions: All lots are restricted to residential use only. No commercial activity, no signs larger than 4 square feet (one for-sale or for-rent sign allowed), no temporary structures, no inoperable vehicles, no recreational vehicles or boats unless the association allows by rule, no high-intensity or visible light bulbs, and no external antennas over 4 feet tall (one per lot). Leases must be in writing and subject to association rules.
- Pets: You may keep up to two dogs, cats, or other household pets, but not for commercial breeding. Pets must be kept inside your lot or on a leash in common areas. The association can make pet rules more restrictive.
- Parking & vehicles: Inoperable vehicles are not allowed, and any vehicle parked over 72 hours can be removed at the owner's expense. Parking spaces may be assigned by lot number on the plat or by the trustees. Recreational vehicles, boats, and travel trailers cannot be parked unless the association allows it by rule.
- Enforcement & fines: The association, the declarant, or any owner can enforce these rules. After 3 days' written notice and a hearing, the trustees can fine an owner up to 10% of the maximum annual assessment per violation. The association can also suspend voting rights and common utility service for unpaid assessments or for up to 60 days for rule infractions.
