This is a Third Amendment to the governing documents for Seis Lagos, a single-family home HOA community in Wylie, TX. It entirely replaces the community's rules on leasing. This document is a partial amendment, not a full rulebook; it updates only the leasing article and the amendment article of the Declaration.
- Leasing & rentals: Leases must be for an initial term of at least 12 months; short-term rentals (less than 12 months, including Airbnb/VRBO) and hotel use are prohibited. No more than 25% of residences in the community may be leased at any one time. Owners must wait 12 months after closing before they can lease, unless they get a hardship exception from the Board.
- Leasing cap & waiting list: Leasing permission is granted on a first-come, first-served basis up to the 25% cap; if the cap is reached, owners can join a waiting list. When a spot opens, owners on the list have 90 days to enter a valid lease or they lose their spot.
- Lease notice & paperwork: Owners must give the Board at least 10 days' written notice and provide contact info for all residents and the lease start date and term. The lease must require tenants to comply with HOA rules, and the owner delegates enforcement authority (including eviction) to the Association.
- Fines for leasing violations: For violating leasing rules, the Association may impose an initial fine equal to one month's rent or $2,500 (whichever is less), plus monthly fines of the same amount until the violation is cured. Leases entered in violation are void.
