What Point Aquarius Property Owners Association's governing documents say
Point Aquarius Property Owners Association is a standard single-family home HOA in Willis, TX, covering multiple sections. The main document here is an amendment and restatement of restrictions for Section 5, plus a set of association-wide Rules and Regulations and an amendment for Section 7. These documents bind all lot owners in Point Aquarius.
- What you own & maintain: You own the individual lot and your home. The association maintains private streets, common areas (general and specific), and provides security, street lighting, and amenities like pools, tennis courts, and a clubhouse.
- Architectural review: All exterior changes—including new construction, painting, fences, pools, driveways, storage buildings, and boat houses—need written approval from the Architectural Control Committee. If they don't respond within 30 days, plans are automatically approved.
- Use restrictions: Only one single-family home per lot (no duplexes, condos, townhouses). Homes must be on a concrete foundation and at least 50% masonry. Minimum living area: 2,200 sq ft for lakefront lots (lots 1-11), 2,000 sq ft for channel/marina lots (12-23) and interior lots. Carports are banned, and no trailers, mobile homes, or temporary structures as residences.
- Parking & vehicles: No vehicle may be parked on streets, easements, or common areas for more than 48 hours. RVs, boats, campers, and trailers must not be visible on any lot for more than 48 hours. Vehicles must be parked on a driveway or approved concrete surface.
- Assessments: Quarterly assessments vary by lot type: initial general commons $72.50/quarter for lots 32-50, $80.00/quarter for lots 1-31 and 51-68. Marina lots (24-68, except 4,31,46,47,49,53,54) pay an additional $30.00/quarter. Special assessments may be levied with 51% owner approval.
- Leasing & rentals: For Section 7, no lease is allowed unless it strictly complies with Section 5.06 of that section's declaration. The main document does not specify minimum lease terms.
- Pets & animals: Only common household pets (dogs, cats) allowed—no livestock, poultry, or commercial breeding. Pets must be leashed or fenced and not a nuisance or threat.
- Fences & landscaping: Fences need ACC approval; chain link is banned, allowed materials are wood, metal, or masonry. Max height 4 ft on waterfront lots, 5 ft on interior lots. No fences in front of the dwelling. Lots must be kept free of underbrush, weeds, and trash.
