Williamsburg Village in Tyler, TX, is a single-family home subdivision governed by a Property Owners Association (POA). These governing documents — the Declaration of Restrictive Covenants, Bylaws, and several supplements — set the basic rules for homeowners. Some proposed amendments (e.g., a 10% cap on rentals, parking on grass, trash can storage) were later rescinded and are not currently enforceable.
- What you own & maintain: You own a single-family lot and detached residence. You must keep your lot, landscaping, and structures in 'neat, well-maintained, and attractive condition,' including regular mowing, watering, and trimming.
- Permitted use & occupancy: Each lot may be used only by a 'Single Family' – defined as people related by blood, marriage, or adoption, or a number of unrelated roommates not exceeding the number of bedrooms. No mobile homes, manufactured homes, or house trailers are allowed.
- Architectural review: An Architectural Control Committee (ACC) must approve all new construction, exterior alterations, and certain landscaping. Residences must be at least 1700 square feet (exclusive of porches and garages) and at least 90% of exterior walls (excluding windows/doors) must be brick or stone. Roofs must be composition shingles. The ACC has 15 days to act or plans are deemed approved; an appeal to the Board is available.
- Parking & vehicles: Parking is allowed on concrete driveways and garages; no overnight parking of ¾-ton or larger trucks, buses, or vehicles carrying hazardous cargo. Inoperable vehicles or those without current tags are prohibited. Revised parking regulations (2013) provide a two-warning process before a $50 fine (and further $50 daily fines). Vehicles may not block driveways or mailboxes.
- Leasing & rentals: A 2022 amendment that would have limited the number of leased residences to 10% and required a minimum three-month lease was later rescinded (2023) because the required vote was not attained. Currently, there is no enforceable rental cap or minimum lease term in these documents.
- Pets & animals: Only common domesticated household pets are allowed (e.g., dogs and cats) and must be confined to a fenced yard or inside the residence. No livestock or poultry.
- Assessments & fees: The Board sets annual Regular Assessments; until changed, the amount is $400 per year. The Board can increase it by up to 10% per year without a membership vote. Special Assessments require a 67% membership vote. A $25 late fee applies after 14 days, with 10% annual interest.
- Common areas & facilities: Owners have an easement to use the common area, including a pavilion and playground. Pavilion use requires a $50 refundable deposit and advance reservation. Playground rules ban roughhousing; unattended toys may be confiscated and disposed of after 90 days.
