- What this document does cover (individual lot restrictive covenants – arbitration & litigation): Several individual lot declarations impose a 15-year term of mandatory mediation and binding arbitration for any dispute between the original home buyer (and future owners/occupants) and the builder, Perry Homes. They also waive the right to a jury trial, limit damages to the purchase price, bar specific performance for the buyer, and give the seller the option to rescind the sale or repurchase the home if repair costs exceed 5% of fair market value. These covenants run with the land and bind all future owners.
