This is a community manual for the NEC Homeowners Association, a single-family HOA in San Antonio, TX. The manual is a supplement to the master declaration and bylaws — it does not contain the full set of rules for the community.
- Solar energy & efficient roofing: Property owners must get prior written approval to install solar panels or energy-efficient roofing. Panels must generally be on the roof, conform to the roof slope, and use silver, bronze, or black framing. Roofing must resemble and match the aesthetics of nearby homes. The association can deny installations during the development period.
- Rainwater harvesting & rain barrels: Rain barrels and rainwater harvesting systems require prior written approval. They may only be placed in a fenced yard or patio, not between the house and the street. They must match the dwelling’s color scheme and cannot have promotional language beyond what the manufacturer displays.
- Flags & flagpoles: Only the U.S. flag, Texas flag, and official armed forces flags are allowed. A single freestanding flagpole is permitted, up to 20 feet tall; a pole attached to the house can be up to 4 feet long. Flagpoles require prior written approval and must be kept in good condition.
- Religious displays: Owners may display religious items at their entry door without prior approval, but the total display area cannot exceed 25 square inches. Items must not threaten public safety, violate law, or be patently offensive. Only the entry door and door frame may be used.
- Assessments, fines & collections: Late fees are $50 per month plus up to 1.5% monthly interest. The association offers alternative payment plans of 3 to 6 months. Fines are set per violation and require a written notice and a hearing before being charged. The association cannot foreclose solely for fines, and any foreclosure requires a court order.
- Board meetings & elections: Board meetings are open to owners, except for closed sessions on personnel, litigation, and privacy matters. Meeting notices must be mailed 10–60 days in advance or posted 72 hours ahead. Owners can vote in person, by proxy, absentee ballot, or electronic ballot, and past-due assessments cannot disqualify an owner from voting.
- Records inspection & copying: Owners may request records in writing; the association must respond within 10 business days and provide copies or inspection dates. Costs are capped by the Texas Administrative Code. Certain records (e.g., individual violation history, payment details, contact info) are not required to be released.
- Xeriscaping: Owners must submit a landscape plan before replacing sod with xeriscaping. At least 50% of the front yard must remain turfed. Non‑turf areas must be bordered, and cannot consist of a single unplanted material. All xeriscaped areas must be kept maintained.
