Dove Creek Subdivision is a single-family-home HOA in Tom Green County, Texas. This declaration of covenants, restrictions, and assessments binds all lot owners and runs with the land. It creates an owners' association to maintain common properties and enforce rules.
- Lot use & dwellings: Each lot is for single-family residential or recreational use only. No mobile homes or house trailers after 12 months from purchase. Modular/prefab homes need architectural committee approval. No subdivided lots smaller than 5 acres. No multiple-family dwellings.
- Buildings & improvements: All structures must be set back at least 30 feet from roads and 30 feet from neighboring lots unless the architectural committee approves otherwise. Plans and specs for any improvement (houses, fences, pools, sheds, etc.) must be approved by the committee before construction.
- Architectural review: A five-member Architectural Control Committee reviews construction plans for quality, design harmony, and location. It rules within 30 days of a complete submission; if it misses that deadline, the request is deemed approved. The committee can charge up to $50 per item reviewed and may enter a lot to correct non-compliance at the owner's expense.
- Animals & livestock: Household pets are allowed. Domestic livestock is allowed at a rate of one head per 2.5 acres (minimum 2.5 acres counted; young under one year excluded). Buffalo or any animal with buffalo blood is prohibited. Stallions are not permitted. No swine.
- Vehicles & storage: No abandoned or inoperative vehicles or machinery on lots. No dumping of junk or trash; containers must be screened from roads and neighbors. Temporary storage of campers and recreational vehicles is allowed, but the committee may regulate their location.
- Assessments & fees: Annual assessments started at $25 per tract (1980). As of 2022, the annual assessment is $50 per tract. The board may increase or decrease annual assessments after 1982. Special assessments for capital improvements require two-thirds member vote. Assessments not paid within 30 days of due date accrue 10% annual interest and become a lien on the property.
- Nuisance & prohibited uses: No noxious activity or nuisance. No business or commercial use except specific exceptions (limited livestock sales, hobby crafts without retail sales, and uses the committee may allow on certain tracts along highways). No quarrying or mining. No gasoline-motor boats on Dove Creek upstream of the first dam.
