Biltmore Swim & Racquet Club Patio Association is a patio home community in Plano, TX. This document is an ancillary policy that tells homeowners how the association finds violations, issues warnings and fines, and conducts hearings — it does not list the actual rules themselves.
- How a violation is identified: A violation is any condition or activity that doesn't comply with the community's governing documents. It's verified by a field observation done by the board or someone they delegate (such as management, a board member, or an architectural committee member).
- Warning and cure period: When a violation is first spotted, the owner gets a letter via first‑class mail and has 15 days from receiving it to fix the problem.
- Notice of Violation and hearing rights: If the violation isn't fixed in 15 days, the association sends a formal Notice of Violation (by first‑class and certified mail). The notice includes the fine or damage claim. The owner has 30 days after receiving it to either fix the violation or request a hearing. If a hearing is requested, it must happen within 30 days of the board receiving the request.
- Hearing and appeal process: The hearing is held in a closed board session. The board must give at least 10 days' notice of the hearing and then notify the owner in writing of the result within 10 days of the hearing. The owner can appeal a delegate's or committee's decision to the board by submitting a written appeal within 10 days of the written result.
- Fine amounts and escalation: Fines are per violation: $25 for the first, $50 for the second, $75 for the third, $100 for the fourth, and $150 for the fifth and each later violation of the same offense.
- Corrective action by the association: If the board decides the violation can be fixed without much expense or trouble, they can do the work themselves after giving written notice to the owner. The owner must pay all costs. The association is not liable for trespass or damages from this action.
- Transfer of liability to a new owner: If an owner sells the home while a violation is being handled, the original owner remains responsible for costs and fines already incurred. The new owner becomes liable for any costs or fines that result from their own failure to fix the violation.
- What this document doesn't cover: This is a fining and enforcement procedure only. It does not list the actual rules for things like pets, parking, landscaping, architecture, leasing, or any other restrictions — those are in the separate Declaration and other governing documents.
