This is a single-family homeowners association (HOA) in Odessa, Texas, called Homestead at Parks Bell Ranch. It is a planned community governed by a Declaration of Covenants, Conditions & Restrictions, Bylaws, and several policies. The rules bind all lot owners and occupants.
- Enforcement & fines: The Association follows a three-step notice process for violations: a Courtesy Notice gives 10 days to cure, a Formal Notice gives 14 days, and a Final Notice gives 30 days. Fines start at $50 and can escalate to $200 per occurrence, but cannot exceed $500 for a single violation. Some violations (e.g., health/safety threats) may be fined immediately without a cure period.
- Vehicle & parking restrictions: Inoperative vehicles, boats, trailers, RVs, and similar equipment may not be stored on driveways, in front yards, or on the street in front of a lot for more than 48 hours, nor more frequently than two times per month.
- Exterior alterations & maintenance: Unapproved exterior alterations are violations. Owners are responsible for exterior property and lawn maintenance at their own expense.
- Prohibited uses: Properties may not be used for business, professional, commercial, or manufacturing purposes. Trash containers must not be stored in public view from the street.
- Transfer fees: The Association charges fees on property transfers: a Resale Certificate ($340), Statement of Account ($50), Refinance Certificate ($50), a Transfer Fee to the management company ($250), an Initial Contribution ($500), and a Capitalization Fee ($187.50).
- Board of directors & elections: After the Declarant Control Period (when the builder controls the board), the board consists of five directors elected by owners for two-year staggered terms. Owners may attend board meetings (subject to rules), and directors may not vote by proxy.
