These are the Amended, Extended and Merged Restrictive Covenants for Cape Conroe, a standard single-family HOA and townhome community in Montgomery, Texas. The document governs all lots in Sections I and II, binding all lot owners (including owners of commercial lots) and is enforceable by the Cape Conroe Property Owners Association.
- Architectural review: No building or alteration may be erected or placed on any lot without prior written approval from the Architectural Control Committee, based on plans, design, materials, colors, and harmony with existing structures. Approval requires the owner to be a member in good standing and current on assessments.
- Building & minimum home sizes: Minimum square footage requirements vary by lot and story type (e.g., single-story must be at least 1700–1800 sq ft exterior area, depending on lot location; one-and-a-half-story must have at least 1400–1700 sq ft total; two-story must have at least 1800 sq ft total; townhouses must have at least 1200–1700 sq ft interior living area). All construction must be new; no used homes or materials allowed.
- Residential & commercial use: Most lots are designated residential and may only be used for a single-family dwelling. No duplexes, apartments, hotels, or transient rentals. A small number of lots are designated commercial. No business use is permitted on residential lots.
- Leasing & rentals: Leases must be for a term of at least six months. Shorter-term rentals are not allowed.
- Pets: No more than two domestic pets per unit. Livestock and poultry are prohibited. Pets must be kept within a fenced or walled enclosure and not allowed to run loose.
- Parking & vehicles: No inoperative, hazardous, or commercial vehicles may be parked on streets or driveways. Recreational vehicles, ATVs, and off-road vehicles may not be operated on subdivision roads or lots unless properly licensed and registered. Boats and boat trailers may be stored on lots.
- Nuisances & maintenance: Lots must be kept free of nuisances including overgrown vegetation (over 1 foot), abandoned wells, open pits, and any condition determined by the Board to be objectionable or hazardous. Garbage must be kept in closed containers and not visible from roadways except on pick-up days.
- Fences, signs & temporary structures: Fences cannot be higher than 6.5 feet; no fence between street and building line. Signs are restricted to one per property for sale. No temporary residences or trailers. Storage structures require Committee approval and must be kept in rear yards.
