What Cottonwood Valley Home Owners Association, Inc.'s governing documents say
This is an ancillary document for Cottonwood Valley Home Owners Association, a standard single-family HOA in Dallas County, Texas. It is not the community’s full rulebook — it records the association’s amended fine schedule and enforcement procedure, and is one of many supplements adding to a chain of earlier recordings. This document tells homeowners what may be fined and how, but does not contain the underlying restrictions themselves.
- Fine schedule — common violations: Fines for curable violations (e.g., parking, pet & animal violations, maintenance, landscaping, rules violations, and nuisance conduct) are $75 for a first offense, $150 for a second, and $200 for a third or later. Uncurable one-time violations (like certain architectural failures or single-family/business use violations) carry a flat $75 fine. Fines may be doubled for repeat offenders of the same or similar violation, and the board may vary the schedule case-by-case.
- Leasing & rentals: Leasing violations (including short-term rentals and non-compliant leases) carry substantial fines: $2,000 initially for a curable first violation and $4,000 per month for additional violations. Providing no notice of a compliant lease results in a one-time $2,000 fine. A lease that is non-compliant triggers a $2,000 initial fine and $4,000 per month ongoing.
- Single-family occupancy & business use: No dwelling may be occupied by more than a single family (defined as related persons plus at most one unrelated person, or two unrelated persons living as a single household, plus any minors under their legal authority). No business, trade, or profession with regular employees or clients may be conducted on a lot. Violating the single-family or business-use restriction is treated as an uncurable violation with a $2,000 initial fine.
- Speeding on community roads: Speeding violations carry escalating fines within any six-month period. Examples: a first violation at 6–10 mph over the limit is $250; at 11–15 mph over is $500 plus a 6-month loss of resident lane access. A fifth violation at 16+ mph over is $4,000 plus a 12-month loss of resident lane access. All subsequent violations double the fifth-violation amounts. Warnings or fines are also tied to the posted speed limit brackets (3–5, 6–10, 11–15, and 16+ mph over).
- Enforcement procedure & hearing rights: The association typically sends a courtesy notice and then a formal notice of violation, allowing a cure period for curable violations. Owners may request a hearing within 30 days; the board must hold it within 30 days of receiving the request and provide documents at least 10 days before. If no notice is required (e.g., for similar violations within six months), the board may impose fines directly. Attorney's fees and costs may be added to the owner’s obligation.
- What this document doesn't cover: This document does not contain the community’s full restrictive covenants, declarations, bylaws, or rules and regulations. It only records the fine schedule and enforcement policy. The underlying restrictions (e.g., architectural guidelines, parking rules, pet limits) are referenced but not reproduced here. For complete rules, homeowners must refer to the recorded Declaration and earlier supplements.
