What Coyote Crossing POA, Inc.'s governing documents say
Coyote Crossing is a standard single-family homeowners association (POA) in Godley, Texas. These policies and guidelines are a collection of administrative rules and property use standards that supplement the main declaration of covenants. They apply to all homeowners and residents in the community.
- Records inspection & retention: Only a member (owner) or their designated agent can request to inspect or buy copies of association records. Requests must be in writing by certified mail and describe each record. The association may charge for production (labor, copies, shipping). The association keeps certain records permanently (formation docs, covenants) and others for set periods (financial books: 7 years; owner account records: 5 years; contracts: 4 years after expiration; meeting minutes: 7 years; tax/audit records: 7 years).
- Email registration & voting: Each owner must register an email address with the association to receive meeting notices and to vote electronically. Failure to register means you may not get email notices and your electronic ballot might not be counted. Voting instruments (ballots, proxies) must be signed and dated; they can be submitted by email, fax, or mail. Proxies can only be cast in person at the meeting.
- Flag display: You may display the U.S. flag, Texas flag, or an official/replica flag of any U.S. armed forces branch. Flags must follow federal and state display rules. Flagpoles are limited to one per property, no taller than 20 feet, and must be attached to the dwelling or freestanding. Flag size max is 4' x 6'. Lights that are a nuisance are prohibited. You need prior written approval from the board or architectural control committee (ACC) for any flagpole installation.
- Alternative payment plan for delinquent assessments: If you are behind on assessments, you (the owner of record) can request a payment plan to pay the delinquent balance in full within 3 to 18 months. The board decides the term. Plan payments must be received by the 15th of each month. While on the plan, no additional late fees, but interest may still accrue. The association may charge a setup fee and monthly administration fee. If you default, you may not get another payment plan for 2 years.
- Drought-resistant landscaping & natural turf: You may use xeriscaping and water-conserving natural turf, but at least 25% of the publicly visible area must be natural turf. You must submit an ACC request or variance request with details; approval is needed before installation. Non-turf areas must be bordered and kept maintained (weeded, trimmed, edged). Plants with thorns/spines cannot be within 6 feet of sidewalks; plants over 12 inches tall cannot be in sidewalk strips. No more than 4 decorative items (urns, pots, statuary) in public view. Boulders over 6 inches are not allowed on the strip between sidewalk and curb.
- Rainwater collection systems: You need prior written ACC approval to install a rainwater harvesting system. Systems are only for outdoor irrigation and foundation watering. Tanks must be opaque, covered, vented, on a stable level surface, no more than 8 feet tall, and screened from public view (backyard only). They must be labeled 'Rainwater Do Not Drink' and maintained to prevent mosquito breeding.
- Roofing materials & solar energy devices: You may install certain energy-efficient or solar roofing materials, but you need ACC approval first. Roof shingles must resemble those on nearby properties and be of equal or greater quality. Solar panels generally must go on the rear-facing roof unless that reduces energy production by more than 10%; they must match the roof slope and be no higher or wider than the roof. Frames and pipes should blend with the roof. Any other location requires ACC approval. These policies override any conflicting rules in other governing documents.
- Violation enforcement & fines: The schedule starts with a first notice via email/mail (7 days to correct or contact). If not resolved, a warning notice follows, then subsequent notices (each 7 days to correct), then final notice. After that, the board may turn the account over to an attorney, and all attorney fees are charged to the homeowner. For 'uncurable' violations (one-time actions like discharging firearms, noise, property damage), a fine may be assessed immediately on first sighting.
