Magnolia Meadows is a standard single-family homeowners association (HOA) in Glenn Heights, TX. This document is a composite of several governing documents (management certificate, pool rules, collection policy, covenant enforcement policy, and bylaws) – it is not a single, complete rulebook. The rules bind all present and future owners, occupants, and guests.
- What this document covers: This excerpt includes excerpts from the management certificate, pool rules, collection policy, covenant enforcement and fine policy, and the bylaws. It does not include the full Declaration of Covenants, Conditions & Restrictions, the full architectural guidelines, or the full owners manual of rules and regulations, which are separate recorded documents.
- Pool rules (amenity): The pool is for residents of Magnolia Meadows and Magnolia Farms only, plus their guests. Hours: Saturday & Sunday, 12:00 pm – 9:00 pm. Pool capacity: 40 people max with a 3-hour time limit. Homeowners must be current on dues for pool key to remain active. Children under 17 must be accompanied by an authorized parent or guardian. Each homeowner is allowed three guests. No diving, running, alcohol, smoking, pets, or glass containers in the pool area. No lifeguard on duty. Violations may result in loss of pool privileges.
- Assessment & dues payments: Regular annual homeowner dues are due and payable on March 1. Other assessments are due on the date specified by the board (with at least 30 days' notice for one-time assessments). Late fees: $30 late fee plus 10% annual interest on past due amounts. A 10-day initial collection notice, a 30-day second notice, and subsequent collection/legal fees may be added. Delinquency may also affect pool key activation.
- Covenant enforcement & fines: Violations are enforced through a three-step notice process (Courtesy Notice – 10 days to cure; Formal Notice – 14 days to cure; Final Notice – 30 days to cure). After the final notice, fines start at $50 (first fine), then $75 (second), $100 (third), and $200 for each subsequent 30-day period, not to exceed $500 per single violation. Owners have the right to request a hearing. Incurable health/safety violations may be fined immediately. Examples of violations: unapproved exterior alterations, inoperative vehicles stored on property, business use, trash containers visible from street, boat/trailer/RV parking on driveway/front yard/street for more than 48 hours or more than twice a month, and exterior maintenance neglect.
- Transfer and sale fees: Resale certificate: $340. Statement of account: $50. Refinance certificate: $50. Transfer fee to management company: $250. New home sales: $500 ($250 operating, $250 reserve). Home resale: one-half the regular annual assessment.
- Board of directors & governance: The board has five directors serving two-year staggered terms. Directors are elected by members; any person may run (no disqualification for delinquent accounts or violations, but certain criminal convictions within 20 years, litigation adverse to the association, or serving more than six consecutive years are disqualifications). During the Declarant Control Period, the developer (D.R. Horton - Texas, Ltd.) appoints most directors and has superior governance rights. Homeowners will gain full control only after that period ends.
- Meetings: Board meetings are open to members; regular meetings must be held at least once per calendar quarter. Members may attend but generally may not participate in deliberations. Special meetings may be called by the president, secretary, or any two directors. The annual membership meeting is held each year; special membership meetings may be called by the board, the president, or by members holding at least 10% of the votes.
- Parking & vehicles: Boat, trailer, marine craft, hovercraft, aircraft, recreational vehicle, motor home, travel trailer, camper, or similar vehicle may not be stored, parked, or kept on any driveway, front yard, or street in front of a lot for more than 48 hours nor more frequently than two times per month.
