What Summit Parc Owners Association's governing documents say
Summit Parc is a standard single-family homeowners association (HOA) in Dallas, Texas. These Bylaws govern the association's structure, board of directors, meetings, rules, enforcement, and owner obligations, but they do not contain the use restrictions, architectural controls, or assessment details that would be in the declaration and other recorded documents.
- Board of Directors & Officers: The board has five directors with staggered 2-year terms. Directors must be owners (or their spouses or entity representatives). At least a majority of directors must be association members. Officers (president, secretary, treasurer) are elected annually by the board.
- Meetings & Voting: Annual owner meetings are held in October. Special meetings can be called by the board or by owners of at least 20% of the lots. A quorum is owners of at least 20% of lots in person or by proxy; if no quorum, a lower threshold of 10% may apply for a rescheduled meeting. Proxies are allowed and expire after one year unless a different term is stated.
- Rules & Adoption: The board has the right to adopt, amend, or terminate reasonable rules for administration, maintenance, and resident health/comfort. At least 10 days before a rule takes effect, the board must give written notice to each owner or publish it. Members and residents may comment orally or in writing before adoption.
- Enforcement & Fines: The board can impose reasonable fines, use self-help to abate violations, and seek court remedies, all after providing notice and an opportunity for a hearing. Fines must be reasonable; interest on unpaid fines is not allowed, and a fine-only debt cannot be foreclosed. Ongoing violations may be fined periodically (daily, weekly, monthly).
- Owner Obligations: Owners must notify the board at least 10 business days before a sale, provide ownership evidence within 30 days, keep the association updated with their mailing address and contact info, register mortgage holder info within 30 days, and pay all assessments.
- Amendments: These bylaws may be amended by members representing at least a majority of lots present at a meeting (if a quorum exists). During the declarant control period, no amendment can affect declarant rights without written consent. Amending the Declarant Control or Drafter's Intent sections also requires declarant approval.
