What Crowley Creekside Homeowner's Association, Inc.'s governing documents say
Crowley Creekside is a standard single-family homeowner's association (HOA) in Crowley, Texas. - Dispute resolution (mandatory mediation & arbitration): The restrictive covenant requires that any dispute between the owner and the builder (including construction-defect claims) be submitted first to mediation and then to binding arbitration—not to court—under the Federal Arbitration Act. This applies even to claims under the Texas Residential Construction Liability Act.
- Warranties & waiver of implied warranties: The builder gives only a written limited home warranty. By signing, the owner waives any claim under an implied warranty of good and workmanlike construction. The builder expressly disclaims any other warranties (including merchantability or fitness for a particular purpose) to the fullest extent allowed by law.
- Mold and biological impurities: The document states that mold growth depends on homeowner maintenance and lists steps to reduce risks. The builder makes no warranty regarding mold or other biological impurities. The owner is responsible for proper maintenance to prevent mold.
