- Enforcement process & your rights: If you violate a rule, the HOA typically sends a courtesy notice giving you at least 14 days to fix the problem. Then a formal Notice of Violation (by certified mail) outlines the violation, proposed fine, and cure deadline. You have 30 days to request a hearing, and you can appeal a committee decision to the Board.
- Fine amounts: Fines escalate: $50 (first), $100 (second, after 14 days), $200 (third, after 30 days), then $400 each subsequent (every 30 days). There is no cap on total fines for the same ongoing violation.
- Other enforcement actions: The HOA may also suspend your use of common recreational facilities, use self-help to cure violations, file a lawsuit, or record a notice of violation against your property. Attorney's fees and costs can be charged to you.
- When the policy does not apply: This enforcement process does not apply to collection of assessments or related costs, nor if the HOA seeks emergency injunctive relief or forecloses on its lien.
- What this document doesn't cover: This amendment only updates the fining and enforcement procedures. It does not contain the actual rules (covenants), architectural standards, use restrictions, or any other governing rules of the community. Those are in separate documents not included here.
