Peach Creek Plantation is a single-family homeowners association (HOA) in Montgomery County, Texas. This policy covers only the HOA's use of surveillance cameras placed on common area. It does not change any other rules in the community's governing documents.
- Purpose & ownership of cameras: Surveillance cameras and footage are owned and operated solely to protect Association-owned property and enforce HOA rules. They are not intended for resident or public safety, and the Association has no duty to provide footage for personal use.
- Who can access footage: Only the Board of Directors and the managing agent may review footage, and only when there is a legitimate need (e.g., documented damage, trespass, or rule violation on common area). Directors must sign a confidentiality agreement before viewing footage.
- Getting footage to law enforcement: If a law enforcement agency (police, prosecutor) requests footage in writing or via subpoena, the Association must release it. If a homeowner wants footage for a crime affecting their own property, they should ask the investigating officer to formally request it. The Board also may vote on releasing footage to an officer at a homeowner's written request.
- Footage preservation length: The Board may set a retention period. If none is set officially, there is no required preservation period, and the Association will only keep footage as required by Texas law.
