What Houston El Norte Property Owners Association Inc.'s governing documents say
This is a master declaration for the Houston El Norte Property Owners Association, a large master-planned community in Liberty and Montgomery Counties, Texas, that currently includes multiple named subdivisions (Montebello, Rancho San Vicente, Liberty Bella Vista, Camino Real, Grand San Jacinto, Santa Fe) and several future tracts. The document creates a master association that oversees common areas, roads, drainage, and a shared bank account for all subdivisions, with the declarant (developer) retaining control until more than 99% of the total acreage is sold. It is intended for current and future homeowners within this growing community and governs the overall structure rather than specific day-to-day rules.
- Master community structure: This master declaration ties together multiple separate subdivisions under one property owners association (POA) that shares common areas, connecting roads, drainage plans, a single bank account, and one board of directors. Each subdivision has its own controlling declaration (listed in the document) that contains the specific rules for that neighborhood.
- Declarant control period & developer rights: The developer (Declarant, Colony Ridge Development, LLC) has the right to appoint board members and unilaterally amend this master declaration until a 'Control Transfer Date,' which occurs when more than 99% of all acreage subject to the association (including future annexed land) has been sold. During this period, the Declarant can annex additional property into the association at its sole discretion.
- Membership & voting: Every lot owner is a mandatory member of the association. Owners other than the Declarant are Class A Members with one vote per lot (only one vote may be cast per lot if multiple owners). The Declarant is the Class B Member and holds three votes per lot owned; Class B membership converts to Class A when the Declarant transfers control.
- Future development & annexation: The Declarant intends to acquire and annex additional land (currently listed as future tracts of 3,126.843 acres, 5,205.913 acres, and 289.05 acres) into the association. These future areas are expected to be developed into residential subdivisions and will be subject to this master declaration when annexed.
- Tax districts & municipal utility district: A Municipal Management District and a Municipal Utility District have been created covering the property. Owners should be aware that a special sales tax and property tax are imposed on the covered property to fund public improvements, services, and commerce.
- Agricultural & timber use on undeveloped land: Until property is developed into residential subdivisions, the Declarant intends to continue using undeveloped land for agricultural and timber purposes. This declaration is not meant to affect agricultural or timber ad valorem tax exemptions on the property.
- What this document doesn't cover: This document is a master overview and does not contain the specific rules for individual subdivisions (e.g., architectural standards, pet limits, parking, leasing restrictions, or maintenance responsibilities). Those rules are in each subdivision's separate controlling declaration, which homeowners should consult for their specific neighborhood.
