Oak Valley Estates Phases 13-18 is a single-family home HOA in Burleson, Texas. This document is the Association's Bylaws — it describes how the HOA is run (officers, meetings, voting, committees) but does not contain the community's actual use restrictions (the 'Restrictions' are a separate document). - Governance & meetings: The HOA is run by a 3-person Board of Directors elected by homeowners. Annual membership meetings are held the second Monday of July at 7:00 p.m. One-third of votes (in person or by proxy) is required for a quorum; 60% of votes present decides most questions.
- Voting rights: Each lot gets one vote, regardless of how many people own it. Proxies are allowed (must be dated 15-30 days before meeting).
- Architectural control: An Architectural Control Committee (initial members: Jim Garrett and Rocky Bransom) approves or disapproves all new construction, landscaping, tree removal, and exterior modifications. Their decisions can be appealed to the Board, except decisions on new construction on vacant lots.
- Committees: Standing committees include Architectural Control, Finance (budget, assessments, collections), Rules & Regulations (enforcing and updating community rules), and Elections (managing board nominations and elections).
- Assessments & liens: The Finance Committee recommends annual assessments. Any lien for unpaid dues is subordinate to purchase-money mortgages, including refinanced loans.
- Changes to the HOA: Additional phases (13-18) are anticipated. Adding other subdivisions requires 80% homeowner approval. Bylaw amendments need a two-thirds vote of members present at a meeting with a quorum.
- Indemnification: The Association will indemnify directors, officers, and employees (unless they're found liable for gross negligence or willful misconduct) for costs incurred in lawsuits related to their role.
- What this document doesn't cover: These Bylaws do not contain the actual use restrictions for lots (e.g., parking, pets, rental rules, architecture guidelines). Those are in a separate Restrictive Covenants document referenced here but not included.
