This document is the Declaration of Covenants, Restrictions and Easements for Holliday Park Subdivision, a standard single-family-home homeowners association (HOA) in Knox County, Tennessee. The covenants, restrictions, and assessments apply to all lot owners in this residential subdivision.
- What you own & maintain: You own your lot and the structure on it. You must keep your lot and home in a neat, clean condition, including mowing grass, pruning trees, and painting. The HOA maintains common areas (like entrance signs and stormwater facilities) and certain easements (like sidewalks).
- Assessments & fees: All owners (except the developer) must pay annual General Assessments and may also be charged Individual Assessments (for fines or lot-specific costs) and Special Assessments (for unexpected repairs or capital improvements). Assessments are a personal obligation and a continuing lien on the lot. Late payments accrue 18% annual interest, plus collection costs and attorney fees.
- Architectural review: No structure (home, fence, shed, deck, etc.) may be built, placed, or altered on a lot until plans are approved in writing by the developer-appointed Architectural Review Committee (ARC). The ARC must approve or deny within 30 days, or approval is automatically granted. Only builders who primarily earn income from construction may build; owners generally cannot act as their own builder unless they also meet that test.
- Use restrictions: Lots are for residential use only. Home-based businesses are allowed if they don't create visible signage, excessive traffic, or overload resources. No mobile homes, campers, tents, house trailers, cabins, or shacks may be used as residences. No satellite dishes larger than 36 inches, and no more than two per lot, may be visible from the street without ARC approval.
- Pets & animals: No animals, livestock, or poultry may be raised, bred, or kept for commercial purposes. Dogs, cats, and other household pets are allowed as long as they are not kept for breeding or commercial use.
- Parking & vehicles: Inoperable or stored automobiles may not be repeatedly parked, kept, or repaired on the street or lawn. Recreational vehicles (boats, campers, trailers, motor homes) must be stored in a garage and kept clean and sightly.
- Fencing: Fencing may be erected only with prior written approval of the developer or ARC, which can consider dimensions, color, type, location, and drainage impact. Unapproved fences must be removed at the owner's expense.
- Signs & clotheslines: Only one temporary construction/real estate sign (max 5 sq ft), one political campaign sign (max 5 sq ft), and no for-rent/for-lease signs. Clotheslines are not permitted.
