Fieldview Subdivision in Summerville, SC is a standard single-family homeowner association (HOA). This document is a 2020 amendment (Third Amendment to the Declaration and First Amendment to the Bylaws) — it changes specific existing rules but is not the full rulebook. The reader should know that these are updates to the community's governing documents, and the complete set of restrictions would be found in the original Declaration and prior amendments.
- Architectural review (ARB): The Architectural Review Board (ARB) must approve all exterior changes, including color, landscaping, fences, and buildings. If the ARB has vacancies, the Board of Directors can temporarily fill them. If the ARB cannot act, the Board may act in its place. Decisions may be based solely on aesthetics. Owners must also get any required government permits.
- Fines & enforcement: The Board may fine owners for violations of the governing documents, with continuing violations possibly subject to daily fines. Fines become individual assessments, bear 18% annual interest, and can lead to suspension of voting rights and common area use (excluding access to the owner's lot). Owners have 14 days to appeal a fine in writing to the Board.
- Assessment collections: Delinquent assessments incur a $25 administrative charge (or amount set by Board), 18% annual interest, late fees, and all collection/enforcement costs. Unpaid assessments become a continuing lien on the property and the personal obligation of the owner at the time the assessment fell due. The Association may accelerate the entire year's balance, sue, or foreclose.
- Parking & vehicles: Parking on common areas is prohibited unless designated. No overnight street, yard, or lawn parking is allowed. Unlicensed or inoperable vehicles cannot be parked anywhere in the neighborhood. No unlicensed vehicle may be operated at any time.
- Trash & recycling: Garbage and recycling containers may be placed on the street only the night before pickup and must be removed by midnight on pickup day.
- Satellite dishes & antennas: Satellite dishes and antennas (under FCC rules) must be installed entirely within the owner's lot, not on common areas, and screened from street view if possible. Owners must notify the Association before installation. Dishes must be less than one meter in diameter, and each lot is limited to one dish or antenna. Inoperable or unused equipment must be removed within 30 days of notice.
- Lakes & waterways: No boats, kayaks, canoes, or stand-up paddle boards are allowed on any lake, lagoon, canal, or waterway. Swimming is also prohibited. Owners must maintain the buffer area bordering their lot, but the Association may also choose to maintain it.
- Board & meetings: The Board of Directors has five members, each serving two-year terms. Directors must be members (owners). Amendments to the Declaration require approval by four of the five directors (75% of the board). Membership meetings require a quorum of 1/10 of the votes, and members may vote by proxy. The annual member meeting is held in January.
