This is a Declaration of Covenants for The Heritage at Dunes West Townhomes, a townhome community in Mount Pleasant, SC. Townhomes are attached dwellings with shared party walls, and the Association maintains common areas, roofs, exteriors, and most landscaping. The rules bind all owners, occupants, and tenants.
- What you own & maintain: You own your townhome lot, interior, and certain appurtenances like HVAC units and patios. The Association maintains common property, roofs, downspouts, gutters, exterior building surfaces (except glass/hardware), all grass, driveways, entry features, and private streets. Owners are responsible for maintaining everything else, including doors, windows, screens, decks, patios, fences, and interior utility lines.
- Leasing & rentals: Leasing is allowed only for residential purposes. Leasing is not considered a trade or business. A professionally lettered 'For Rent' sign (max 4 sq ft) may be displayed. Owners must provide notice of sale or lease.
- Business use: Townhomes are for single-family residential use only. Ancillary home businesses are allowed if not visible, audible, or detectable from outside; do not increase traffic or insurance; and are consistent with the residential character.
- Vehicles & parking: Only a reasonable number of vehicles per townhome as determined by the Board. Parking is allowed only in driveways or authorized areas. Disabled, stored, or commercial vehicles (including boats, trailers, RVs, and trucks over 1 ton) are prohibited from parking unless designated areas exist. Vehicles may be towed after notice.
- Pets: Only a reasonable number of household pets allowed. No commercial breeding. Prohibited animals include potbellied pigs, venomous snakes, and breeds the Board deems dangerous (pit bulls, rottweilers, Dobermans). The Board may require removal of any dangerous or nuisance animal on 7 days' notice.
- Architectural review: Any exterior change (painting, landscaping, fences, satellite dishes over 1 meter, signs, etc.) requires prior written approval from the Architectural Control Committee (ACC) and the Master Association. Applications are deemed approved if no response within 45 days. Fences must be approved; chain link and free-standing hog wire are prohibited.
- Assessments: Annual and special assessments are levied per townhome. The Board can impose special assessments up to $500 per year per townhome without a vote. Unpaid assessments accrue late fees, interest (up to 18% per year), and become a lien. The Association can suspend utility services after 10 days' notice for delinquencies over 60 days.
