This is the Declaration of Covenants and Restrictions for The Preserve II at Fenwick Hall, a planned single-family home community in Johns Island, SC. It creates a property owners association (POA) that manages common areas, enforces rules, and collects assessments. This document binds all lot owners, their tenants, and guests.
- Lot use & construction: Lots are for single-family residential use only. Each lot may have one detached house of at least 2,500 sq. ft. of living space plus one accessory building (e.g., garage, guest house). Exterior construction must be completed within 12 months of starting.
- Architectural review: An Architectural Review Board (ARB) must approve all exterior changes, including new construction, landscaping, grading, fences, decks, painting, and signs (except certain 'For Sale' signs). The ARB can deny changes for purely aesthetic reasons, and may charge application fees and require deposits.
- Leasing & rentals: Whole-house leases only; no renting individual rooms. Minimum initial lease term is 12 months. Short-term, transient, or hotel use is prohibited. All leases must be in writing and acknowledge that tenants are bound by the declaration and bylaws.
- Assessments & fees: Annual and special assessments are levied per lot (one vote per lot). There is a transfer fee of 0.25% of the purchase price (based on county recording fees) due on resale. Unpaid assessments accrue 10% annual interest and can become a lien on the lot.
- Pets & animals: Dogs, cats, and normal household pets are allowed indoors and on lots. The board may ban certain breeds, limit numbers, require leashing, and order removal of nuisance pets. Dog pens, chains, and outdoor enclosures are prohibited unless ARB-approved.
- Parking & vehicles: No outside storage or parking of boats, campers, mobile homes, commercial vehicles, motorcycles, or ATVs. Golf carts may be allowed by exception. Vehicle repair is only allowed inside enclosed garages or for emergencies.
- Trees & landscaping: Owners cannot cut or remove trees with a trunk diameter of 6 inches or more (measured at 4.5 ft above ground) without ARB approval, except dead or diseased trees certified by the ARB. The association can maintain landscaping on lots to ensure uniform appearance.
- Common property & amenities: The association owns and maintains common areas, including docks, walkways, and landscaping. Owners have non-exclusive easements to use common property, subject to association rules. The board may suspend use rights for unpaid assessments or rule violations (up to 30 days).
