Canebrake is a single-family home subdivision in Greer, SC, governed by restrictive covenants that run with the land and bind all lot owners. These rules dictate what you can build, how you can use your property, and your obligations to the homeowners association. This document covers only the original recorded covenants; any later amendments or association rules would also apply.
- Single-family residential use only: Each lot must be used for a single detached single-family dwelling. No businesses, commercial activities, trailers, or mobile homes are allowed on any lot.
- Architectural review: Before building, altering, or adding any structure (including fences, walls, driveways, and landscaping), you must get written approval from the Architectural Committee. Plans for new residences must show the type, design, and location, plus a landscape plan. The committee can reject designs it finds unsuitable or too similar to existing buildings; if they don't act within 30 days, approval is presumed. They may allow minor setback violations (up to 5 feet front, 3 feet side, or up to 15 extra square feet) to avoid hardship.
- Setbacks & building size: Buildings must be set back at least 10 feet from side lot lines (or 10% of lot width, whichever is greater), and at least as far as the front setback line shown on the plat. Detached garages/outbuildings must be at least 60 feet from the front line and 5 feet from side/rear lines. Minimum heated floor areas: 1,550 sq ft for one-story homes; 1,800 sq ft for two-story, one-and-a-half story, split-level, and tri-level homes (with specific per-floor minimums). Basement homes have lower main-level minimums (1,450 or 1,550 sq ft) depending on basement size.
- Pets & animals: Only cats, dogs, and caged birds are allowed as pets, and only in reasonable numbers for the occupants' pleasure. No other animals may be kept or quartered on any lot.
- Parking & vehicles: No trucks larger than 3/4 ton may be parked on the property or on subdivision streets. Camping trailers, boats, and similar recreational equipment must be parked to the rear of the dwelling and be inconspicuous (side-yard parking allowed only with committee approval). All vehicles must have current license tags; abandoned vehicles may be removed after 7 days. Parking on streets is limited to temporary periods; off-street parking is required for domestic servants' cars.
- Maintenance assessments (HOA dues): Each lot is subject to an annual maintenance charge (initially $36/year per Phase II, but originally $3/month per Phase I and adjustable by majority vote of lot owners). Dues are payable to Canebrake Homes Association, Inc. The association may use funds for operation, street/park maintenance, recreational facilities, weed control, and enforcement. Delinquent charges accrue 8% annual interest and legal fees, and become a lien on the property (subordinate to mortgages).
- Lake & recreational area use: The lake and recreational area are for use by Canebrake lot owners (all phases) and their guests/invitees only, at their own risk. Only hand- or electric-motor-powered boats are allowed; no commercial use, no debris, and no buildings on the lake shore except an open landing dock permitted by the Architectural Committee. The association may adopt additional rules for the area.
- Signs: Only one sign per lot is allowed, for sale or rent, no larger than 24 inches wide by 20 inches high.
