Barham Reserve is a single-family home HOA in Wake Forest, NC. This document is the full rulebook—Articles of Incorporation, Bylaws, and Declaration of Covenants—binding all lot owners. It establishes the homeowners association, sets use and building restrictions, and defines common areas and assessments.
- What you own & maintain: You own your lot and the single-family home on it; you must maintain the exterior, landscaping, fences, and keep lawns under 8 inches. The association maintains common areas including the pond, entrance features, private streets, and stormwater facilities.
- Architectural review: Any exterior construction, alteration, or landscaping must be approved by the Architectural Control Committee (ACC). Plans are deemed approved if the ACC does not approve or disapprove within 30 days. Approval does not assume liability for design or structural defects.
- Land use & business restrictions: Lots are for single-family, non-transient residential use only. Home offices are allowed if no customers visit and no sign or external evidence of business exists. No business activity is permitted outside the dwelling.
- Signs: No signs allowed without board approval except one professionally lettered "For Sale" or "For Rent" sign (max 5 sq. ft., max 5 ft. height) and signs required by legal proceedings. Until Dec 31, 2022, the Declarant may use any size marketing signs.
- Parking & vehicles: All vehicles must be properly licensed and registered. Parking is only allowed in the garage, behind the front of the house, or on a concrete parking pad. No parking on streets or on lawns. Recreational vehicles (boats, trailers, etc.) are included in the vehicle rules.
- Assessments & fees: Each lot owner must pay annual and special assessments, secured by a continuing lien. Assessments not paid within 10 days of the due date incur a monthly late charge; after 30 days they bear 18% annual interest (or the maximum allowed). The association may foreclose on the lot for nonpayment.
- Membership & voting: Every lot owner is a member of the association. Each lot gets one vote (Class A). The Declarant and Builder get 10 votes per lot owned (Class B) until 85% of lots are sold or Dec 31, 2025, whichever comes first. Voting rights are lost if assessments are over 60 days delinquent.
