The Preserve at Tidewater (also known as Alligator Bay) is a standard single-family home HOA in Sneads Ferry, NC. This Declaration of Covenants, Conditions and Restrictions (CCRs) binds all lot owners, residents, and guests. It covers use restrictions, architectural control, assessments, and maintenance obligations.
- What you own & maintain: You own your lot and dwelling. You must maintain your lot free of weeds and debris, and you are responsible for your sewer system from the home to the sewer tie-in box, including the lateral line and grinder pump. The association maintains common areas, including open space and the sewer force main.
- Architectural review: Any exterior change (building, addition, landscaping, color change, etc.) requires prior written approval from the Architectural Review Committee. The committee has broad subjective aesthetic judgment. No approval is needed for interior work or restoration identical to previously approved work.
- Use restrictions: Lots are for residential use only. No temporary structures, trailers, or outbuildings as residences. No noxious activities or nuisances. No inoperable or unregistered vehicles; no vehicle repairs visible from the street. No camper trailers, motor homes, or boats may remain on lots or streets. No animals, livestock, or poultry except household pets (dogs, cats) kept leashed and not a nuisance. No yard statuary or yard art; satellite dishes over 18 inches or visible from the street are prohibited. No flags except U.S. or North Carolina flags, and no vertical flagpoles; flags no larger than 4'x6'. No political signs on lots or common areas. Christmas decorations only Nov 20–Jan 7.
- Leasing & rentals: The document does not address lease terms or rental restrictions. However, all tenants and occupants must comply with the Declaration.
- Assessments & fees: Annual assessments are set by the board based on a budget ratified by lot owners. Special assessments for capital improvements require a majority vote. Insurance assessments may be levied. Assessments are a personal obligation and a lien on the lot if unpaid. Late fees and interest apply. The association may foreclose on the lien.
- Parking & vehicles: No camper trailers, motor homes, tractor/trailers, or similar vehicles may remain on lots or streets. Inoperable or unregistered vehicles are prohibited and may be towed at owner's expense. Vehicle repairs may only be done in garages or areas not visible from the street. Parking must not impede access to other lots.
- Pets: Household pets (dogs, cats) are allowed but must be kept leashed or under control, not for commercial purposes, and must not become a nuisance. Owners must immediately dispose of pet waste on common areas or roadways.
