- Amendment of the Declaration: The Declaration can be amended by a vote of at least two-thirds (2/3) of the undivided interest of all unit owners. Any amendment must be recorded and, if required by law, approved by the Raleigh City Attorney.
- Eminent domain: If part of the common elements is taken by eminent domain, the award goes to the Association to repair or replace the remaining common elements. If more than two-thirds of the general common elements are taken, the condominium regime may be terminated.
- Merger of units: The Association may authorize removal of a party wall between two units to combine them, but only if the units are used together as one unit. The square footage and ownership percentage from Exhibit D cannot change.
- Invalidation: If any part of the Declaration is ruled invalid, the rest of the Declaration remains in effect.
- Tri-Party Agreement regarding wastewater: The Association is obligated to maintain and operate the wastewater collection and treatment system, levy assessments to fund it, and prioritize it after taxes and insurance. The Association must convey the system to any available governmental utility if it becomes available.
