Sandy Forks Place Condominium is a condominium community in Raleigh, NC — you own your individual unit and share ownership of the common elements. This document is the original Declaration of Condominium establishing the property, so it sets the basic rules for owners, but does not include the association's bylaws or any later rules. Key rules include no leases under 30 days and that each unit is for single-family residential use only.
- What you own & maintain: You own the interior of your unit (walls, floors, ceilings, surfaces, and unit-specific HVAC). Exterior walls, roofs, structural elements, and common areas are maintained by the association. You must keep your unit in good repair and get board approval before making structural changes.
- Leasing & rentals: Leases must be for at least 30 days — no short-term or transient rentals. Each lease must be in writing on a form approved by the association and must state that the tenant is bound by the condominium documents. Renting individual rooms is not allowed.
- Use & occupancy: Each unit may be used only as a single-family residence. No signs visible from outside are allowed without board permission. Nothing may be stored in common areas. No activity that creates a nuisance or increases insurance rates is permitted.
- Pets: No animals, livestock, or poultry may be kept in any unit or common area except as permitted by rules the board may adopt. This document does not set specific pet limits or types.
- Assessments & fees: Each owner pays monthly common expense assessments proportional to their unit's undivided interest in the common elements. Special assessments may be levied with approval of at least 51% of owners. A working capital fund equal to three months' expenses is collected at the initial sale.
- Insurance: The association carries a master policy covering the buildings, common areas, and fixtures (replacement cost). Owners are responsible for insuring their own personal property and interior finishes. The policy includes liability coverage of at least $1 million per occurrence and fidelity coverage for funds handlers.
- Parking: Parking garages are limited common areas; other parking spaces are common areas. The board may assign specific spaces. In no event shall there be fewer parking spaces per unit than required by the Raleigh City Code.
- Amendments & future development: This Declaration may be amended by owners holding at least 75% of common interest, with mortgagee consent and developer approval if developer still owns 25% of units. The developer retained the right to add Phase II (up to 6 units) and Phase III (up to 66 units) within five years, and Phase I owners automatically consent to such additions and their percentage interest adjustments.
