What Riverbrooke Homeowners Association (NC)'s governing documents say
Riverbrooke is a standard single-family HOA in Raleigh, NC. This document is the full declaration of covenants, conditions, and restrictions that run with the land and bind all homeowners. It creates the homeowners' association, defines the common area, sets up mandatory assessments, and establishes rules for architectural control, property use, and enforcement.
- Membership & voting: Every lot owner is a member of the association with one vote per Class A (owner-occupied) lot. Vacant or leased lots have their vote capped at 49% weight on any matter. The developer initially holds three votes per Class B lot, which converts to Class A by Dec. 31, 2004 or earlier when Class A votes equal Class B votes.
- Property rights & common area: Owners have an easement to use the common area (open space, stormwater facilities, greenways) and may delegate use to family, tenants, and guests. The association maintains, insures, and may regulate the common area, including charging fees for certain facilities. A greenway area is subject to City of Raleigh approval and public recreational use.
- Assessments & fees: All owners must pay annual assessments and may be charged special assessments for capital improvements. The initial maximum annual assessment was $120 per Class A lot ($10/month) and $30 per Class B lot, with annual increases capped at 10% unless approved by two-thirds of Class A votes. A working capital fee of 1/6 of the annual assessment is collected at initial sale. Late payments incur a 14% annual interest charge and a lien on the lot.
- Architectural control: No building, fence, wall, or major landscaping may be started without written approval from the Declarant (or delegated architectural committee) within 30 days of submitting complete plans. The Declarant may charge a review fee up to $75 and can enforce a uniform design standard.
- Enforcement & sanctions: The association may impose monetary fines (which become a lien on the lot), suspend voting rights or common-area access for up to 60 days per infraction, tow vehicles in violation of parking rules, and suspend services to owners more than 30 days delinquent. Self-help remedies are allowed.
- Leasing & rentals: The document does not impose a minimum lease term or limit the number of rentals, but if a lot is leased or vacant, the owner's vote is weighted at no more than 49% on any matter before the association.
- Amendments & term: The covenants run for 25 years from recording (1997), then auto-renew for successive 10-year periods unless terminated or altered. Amendments require 80% of lot owners during the first 25 years and 75% thereafter. FHA/VA approval is required if applicable.
- What this document doesn't cover: Pets, parking restrictions (except towing authority), rental caps, age restrictions, and specific utility obligations for individual lots are not addressed in this declaration.
