Park Glen Condominiums (Raleigh, NC) is a condominium community — you own your individual unit and share ownership of the common areas, which the association maintains and insures. This document establishes the legal framework for the community, covering what you own, what the association maintains, how the community is run, and the rules you must follow as an owner. It also allows the developer to add up to 96 total units in multiple phases.
- What you own & maintain: You own the interior of your unit (including the subflooring, wall and ceiling surfaces), your patio/balcony, and a designated storage area. You are responsible for maintenance and repair of everything inside your unit, including HVAC equipment, appliances, interior surfaces, and all glass doors, window frames, panes, and screens. The association maintains everything outside the unit — the building's structure, common hallways, stairs, plumbing, wiring, and other common property.
- Leasing & rentals: Leases must be in writing for at least 30 days (no short-term rentals). All leases must include a clause stating the lease is subject to the Declaration, Articles, and Bylaws, and that a tenant's failure to comply is a lease default. No unit may be used for transient hotel or commercial purposes.
- Assessments & fees: The association levies annual and special assessments payable in monthly installments. The annual assessment can be increased up to 10% per year without member vote; increases above 10% require a vote of owners holding two-thirds of the common interest. A working capital fund of two months' current annual assessment is paid at closing. Assessments are secured by a lien on the unit.
- Pets: Dogs, cats, or other household pets may be kept inside a unit (not for commercial purposes), but they must be on a leash in common areas. The association may adopt rules limiting the number of guests and may prohibit animals entirely from common areas.
- Architectural review: No structural modifications to your unit, changes to the exterior, or alterations to common or limited common areas (including fences, planting, painting, antennas) may be made without the association's written consent. The association may require you to cover the cost of maintaining, repairing, and insuring any approved alteration.
- Parking & vehicles: At least 24 parking spaces are provided. Boats and trailers may only park in a designated area. The association may make permanent or temporary assignments of parking spaces.
- Insurance: The association must maintain casualty insurance covering the buildings and improvements (100% replacement cost), liability insurance (at least $1 million per occurrence), and fidelity bonds covering those handling association funds. Unit owners may obtain their own policies for personal property and liability.
- Quiet enjoyment & nuisance: No nuisance, unreasonable noise, or any use that interferes with other owners' peaceful possession or increases the insurance rate. All laws and zoning must be observed.
