This document is a stormwater maintenance covenant required by the City of Raleigh for the Oberry Condos Phase 2 development. It is not a full set of homeowner/condominium rules but a legally recorded obligation running with the land that requires the Oberry Townhome Condominium Association (or a designated responsible party) to maintain on-site stormwater control facilities (underground detention and sand filter) in perpetuity, and grants the City enforcement and reimbursement rights.
- Stormwater facility maintenance obligation: The Association (Oberry Townhome Condominium Assoc., Inc.) or commercial lot owner is responsible for maintaining the stormwater control facilities – a 7x15x5 underground detention vault and a 3-8’x16’ underground sand filter – according to the approved Operations and Maintenance Manual (Exhibit C). This includes monthly, quarterly, semi-annual, and annual inspections and cleanouts.
- Annual budget & replacement fund: The estimated annual maintenance cost is $1,000 plus a $750 annual engineer inspection. A facility replacement fund is also required. Total construction cost is estimated at $102,500, backed by a 125% surety bond/letter of credit ($128,125).
- City enforcement & reimbursement: If the facilities are not properly maintained, the City of Raleigh may perform maintenance itself and levy assessments against each lot served. The City can also seek specific performance in court and assign assessment rights from the Association. Each lot owner is jointly and severally liable for unpaid maintenance costs.
- Insurance required: The responsible party must carry liability insurance of at least $1,000,000 for the stormwater facilities.
