- Tree conservation and landscape easements: Tree conservation areas shown on plats are protected; no tree-disturbing activity is allowed without a city permit. The association must maintain and replant shrubs/trees in designated landscape easements, and these costs are common expenses.
- Private streets and utility lines: If the development includes private streets or water/sewer lines serving more than one lot, the association must maintain them. The city has the right to perform maintenance on private utility lines if the association fails, and can assess costs and file liens against lots. Private street maintenance and traffic flow are the association's responsibility.
- Common party walls (townhouses or attached units): Common party walls must meet building code. Maintenance costs are shared by the owners who share the wall, and if a wall is damaged by fire or casualty, the cost to repair is shared proportionally. An owner who damages a wall by negligence or willful act bears the full cost.
- Enforcement and city rights: The city may seek injunctive relief and specific performance for violations of this covenant. Owners and the association must comply with all applicable city code provisions, and if other governing documents conflict, the more restrictive city code requirement prevails.
- Insurance requirements: The association must carry hazard insurance on common elements and liability insurance of at least $1,000,000. Premiums are a common expense.
