Lake Woodard Townhome Association is a single-family townhome subdivision in Raleigh, NC. Each owner holds fee simple title to a lot and the attached townhome, with shared responsibility for common areas and exterior maintenance through the association. This declaration binds all owners, tenants, and guests.
- What you own & maintain: You own your lot and the townhome structure. The association maintains the common area (including landscaping, roofs, gutters, siding, and fencing) and carries liability insurance of at least $1,000,000 for the common area. Owners must keep their lot free of trash and maintain the exterior in a pleasing appearance, except for the items maintained by the association.
- Leasing & rentals: Leases must be in writing for a term of at least 180 days (about 6 months). Short-term or transient rentals (e.g., hotel-type stays) are prohibited. The lease must state it is subject to this declaration and the bylaws.
- Pets & animals: No livestock or poultry. A reasonable number of domesticated household pets is allowed, provided they are not kept for commercial purposes, are restrained when outside, and any outdoor shelter is approved and not visible from the street.
- Architectural review: No exterior improvements (including fences, sheds, lawn ornaments, window treatments like foil or reflective film, or utility devices) may be built or installed without written approval from the Architectural Committee. Plans and specifications must be submitted; approval or denial must occur within 30 days. Fences cannot exceed 6 feet in height and must not be closer to the street than the front building line.
- Parking & vehicles: Boats, recreational vehicles, and trailers must be stored in a garage or screened from view. No inoperative or abandoned vehicles may be parked on any lot or street. Owners and tenants cannot park on subdivision streets; off-street parking must be provided.
- Assessments & fees: Annual assessments start at a maximum of $600 per lot (as of 2000) and can increase up to 10% per year without a membership vote. Special assessments require a two-thirds vote of each class of members. Delinquent assessments incur a $25 late fee and 12% annual interest, and may become a lien on the property that can be foreclosed.
- Party walls: Walls between attached townhomes are party walls. Owners sharing a wall must split repair and maintenance costs proportionally. Damage from negligence is the responsible owner's cost. Disputes about party walls must go to binding arbitration.
