What Hunters Pointe Owners Association Inc's governing documents say
This is not the community's HOA rules for residents. It's a stormwater maintenance covenant for Hunters Pointe, a new single-family subdivision in Raleigh, recorded by the developer (Lennar) to comply with City of Raleigh ordinances. This document binds the future homeowners' association (Hunters Pointe Owners Association, Inc.) and individual lot owners to maintain a constructed stormwater wetland (SCM A) forever. It gives the City of Raleigh rights to inspect, enforce, and even step in to do the maintenance and charge owners.
- Who is responsible for the stormwater facility: Once the developer transfers control, the Hunters Pointe Owners Association (or, if set up that way, a commercial lot owner) becomes the 'Responsible Party' for maintaining the stormwater wetland. If the Association is responsible, every lot served by the facility must be a mandatory member. If owners don't keep up, the City can do the work and bill them.
- What maintenance is required: The association must follow a detailed Operations and Maintenance Manual (Exhibit C). Key tasks: mow embankments monthly (grass under 6 inches, using string trimmers on slopes), inspect monthly and after every 0.5-inch rain, check for erosion/cracks/slides biannually, remove sediment when it reaches 6 inches deep, maintain the outlet/riser structure, manage wetland plants, control rodents, and keep the water level right (including using a well pump if needed).
- Inspections and reporting to the City: Monthly and post-rainfall inspections are required. A registered professional engineer must do an annual inspection and file a report with the City within 30 days of the anniversary of the as-built certification. The engineer's report must use City-approved forms.
- Insurance required: The Responsible Party must carry liability insurance of at least $1,000,000 for the stormwater facilities.
- Costs and funding: The estimated annual maintenance cost is about $12,514. The developer paid the City 24% of the estimated replacement cost ($170,295). The remaining 76% ($129,424) should be collected into a sinking fund by the association over 30 years (about $4,314 per year). The association can levy assessments on lot owners; unpaid assessments become a lien on the lot.
- City of Raleigh's enforcement rights: If the facility isn't maintained, the City can enter the property, do the work, and charge owners. The City can also levy its own assessments (which become liens) and can even use the association's assessment powers to collect unpaid costs. The City gets a permanent easement to access and inspect the stormwater facilities.
- What this document doesn't cover: This document only covers stormwater facility maintenance. It does not contain any HOA rules about pets, parking, architecture, leasing, noise, or other typical community living restrictions. Those rules, if they exist, would be in a separate declaration of covenants and restrictions.
