This is a 2023 amendment to the Declaration of Condominium for Cottages at Brier Creek, a condominium community in Raleigh, NC. It changes only the rules for how insurance deductibles are paid and how the association handles rebuilding after a casualty. It does not contain the full set of community rules — it is a partial document that modifies two specific sections of the original Declaration.
- Insurance deductible responsibility: The association chooses the deductible amount for the master policy. If damage involves both common elements and units, the deductible is a common expense. If damage is only inside one or more units, the owners of those units pay the deductible proportionally, and it becomes due immediately. Unpaid amounts become a lien on the unit after 30 days.
- Rebuilding after damage: The association must promptly repair and restore buildings after a casualty, unless all owners (100%) vote not to rebuild, or rebuilding would violate health/safety laws. The association only covers structural repair — not interior decorations, wall/floor coverings, or furnishings — unless the master policy covers them. Costs above insurance are a common expense.
- What this document doesn't cover: This amendment does not address pet rules, leasing restrictions, age limits, parking, or any other typical community rules. It only changes insurance deductible allocation and rebuilding procedures. The full Declaration (recorded in Book 12967, Page 2163) contains those other rules.
