What Banks Pointe's governing documents say
Banks Pointe is a single-family home subdivision in Raleigh, NC, governed by a homeowners' association (the Banks Pointe Owners' Association, Inc.). The document provided is a set of amendments to the original Declaration of Covenants, Conditions and Restrictions – it is not the full rulebook, so it only shows changes made over time. These rules bind all lot owners in the subdivision.
- Architectural review & exterior changes: Before building, painting, or making any exterior change (including color), you must submit plans to an Architectural Control Committee appointed by the Board. The committee has 30 days to approve or disapprove; if they don't act in that time, approval is not needed as long as the work is in general conformity with the subdivision's overall appearance. Refusal can be based on any ground, including purely aesthetic reasons. The committee must have at least 3 but no more than 7 members.
- Minimum home size & construction quality: All homes must have at least 2,000 sq ft of heated floor space for one-story homes, or 2,400 sq ft for one-and-a-half to two-story homes. Minor violations of 10% or less may be waived. No mobile homes, manufactured homes, or modular homes are allowed. Exterior materials must be new; metal roofs (with written committee consent) are allowed, but metal or vinyl siding and exposed cinder/concrete block are prohibited.
- Parking & storage of vehicles: All trailers, campers, vans, boats, and RVs must be parked in the back yard and not visible from the street, and must be screened with landscaping or other materials approved in writing by the Declarant or the Association.
- Fences: Wood or chain link fences are not permitted.
- Assessments & fees: Annual and special assessments are fixed at a uniform rate per lot and collected quarterly. Vacant lots pay no more than 50% of the assessment for a built lot until the first day of the month after a certificate of occupancy is issued. Assessments start the first day after a lot is conveyed to an owner.
- What this document doesn't cover: These are only amendments to a larger Declaration. The full set of rules (including leasing restrictions, pet rules, maintenance obligations, insurance requirements, and any other original covenants) is not included here. You need to read the original Declaration and all amendments together.
