Gray Shores is a standard single-family home HOA in North Topsail Beach, NC. This declaration of covenants, conditions, and restrictions (CC&Rs) applies to six specific lots and creates the Gray Shores Property Owner's Association. It governs land use, building standards, maintenance obligations, and assessments for all lot owners.
- Land use & building type: Lots are for residential use only. Only single-family dwellings (max 2.5 stories), a private garage (may include servant quarters), and reasonable outbuildings are allowed. Minimum ground floor area: 1,200 sq ft for one-story, 1,000 sq ft for multi-story (excluding porches and garages).
- Setbacks & location: Buildings must be at least 15 feet from rear lot lines, 8 feet from interior side lot lines, and comply with recorded plat front/side street setbacks. A 10% error in location is not a violation.
- Pets & animals: No livestock or poultry. Customary household pets (dogs, cats) are allowed but not for commercial purposes. Pets must be leashed and under control when off the owner's lot.
- Architectural review: Building plans must meet FHA Minimum Property Standards (FHA No. 300). Fences up to 5 feet high, made of wood or vinyl, are allowed between the front of the dwelling and the rear lot line.
- Temporary structures & vehicles: No trailers, tents, shacks, or temporary structures. Recreational vehicles may remain on a lot if not set up permanently and without attached shelters or decks.
- Assessments & fees: Annual assessment starts at $300 per lot until the first lot is sold to a homeowner. Thereafter, the board may increase it up to 15% per year; larger increases require 2/3 owner vote. Special assessments need 2/3 board and 2/3 owner approval. Assessments are a lien on the lot if unpaid after 30 days, with 10% annual interest and collection costs.
- Maintenance obligations: Lot owners must maintain their lot, easements, and improvements. The association or declarant may enter and perform maintenance if the owner fails, and the cost becomes the owner's personal obligation (but not a lien unless a court judgment is obtained).
