What Southpointe Owners Association, Inc.'s governing documents say
This is an architectural, landscape, and lake buffer guidelines document for SouthPointe, a single-family home community in Morganton, NC, with a homeowners association (HOA). It applies to lot owners (homeowners) who are building or modifying homes, not to renters or unit owners, and it supplements the community's Declaration of Covenants.
- Architectural review & approvals: All new construction, additions, remodeling, fences, walls, outbuildings, and major landscape changes require prior written approval from the Architectural Control Committee (ACC). Fees include a $750 ACC review fee for a residence, $250 per change request after two, $400 resubmittal fee, a $5,000 construction escrow, and a $1,000 shoreline escrow (amounts subject to change).
- Minimum dwelling size & height: Minimum heated floor area varies by lot type: waterfront lots require at least 1,800 sq ft (1-story) to 2,200 sq ft (2-story); off-water lots require at least 1,600 sq ft (1-story) to 2,000 sq ft (2-story). No dwelling may exceed 2½ stories above ground level.
- Lot & site restrictions: All structures must be within the ACC-defined Building Envelope for each lot. Setbacks are generally more restrictive than county minimums. Driveways must be at least 2 feet from side lot lines, and front-entry garages must be recessed at least 36 inches from the main facade. Only one detached single-family home and one 2- to 3-vehicle garage per lot.
- Exterior materials & design: Approved exterior materials include brick, stucco, stone, cedar shake, or horizontal siding; imitation stone/brick is discouraged and requires ACC approval. Minimum roof pitch is 6:12. Acceptable roofing includes wood shingles/shakes, slate, tile, or 25-year architectural shingles. Windows, doors, chimneys, and porches must meet specified design standards.
- Pools, play equipment & outbuildings: Swimming pools, spas, play sets, sheds, gazebos, and other outbuildings require ACC approval. Pools and decks may not be placed outside the Building Envelope except that pool decks may encroach up to 10 feet from lot lines on non-lake lots if at or near grade. Play equipment must be in the middle third of the lot and made of wood with earth-tone colors.
- Fences & walls: Fences and walls require ACC approval, may not exceed 6 feet in height, and must not be placed nearer to the street than the rear building corner of the house. No fence or wall may substantially obstruct lake views from neighboring waterfront lots.
- Lake buffer & tree preservation: A 100-foot minimum Lake Buffer is protected from the 1200-foot contour on waterfront lots. All trees outside the building envelope are considered protected; clearing is limited to what is needed for construction. Tree protection fencing is required, and damaged trees must be repaired by a qualified arborist.
- What this document doesn't cover: This document does not cover general HOA rules (e.g., parking, pets, noise, leasing, assessments), which are in the separate Declaration of Covenants, Conditions and Restrictions. It is a partial guideline focused on construction, design, landscaping, and lake buffer standards.
