Arbor Creek is a large master-planned, planned unit development (PUD) in Holly Springs, NC, governed by a Master Homeowners Association (the "Master Association") and potentially smaller Sub-Associations for individual neighborhoods. This Master Declaration establishes the overall framework of covenants, restrictions, and assessments that apply to all property owners in the community, whether they own a single-family home, townhouse, or condominium unit.
- What you own & maintain: You own your Lot or Unit in fee simple. The Master Association owns and maintains the Common Area (e.g., roads, pools, clubhouse, entrance features). A Sub-Association (if one is formed for your section) may own and maintain Limited Common Area (e.g., driveways, parking serving a townhouse group). You are responsible for maintaining your own Lot and any improvements on it.
- Assessments & fees: All owners (except those with Undeveloped Lots) pay an annual assessment to the Master Association. Vacant Lots pay 50% of the regular rate. The initial maximum assessment per month was $30 per Unit and $15 per Vacant Lot (see Exhibit B). This amount can increase annually by up to 10% (or the CPI increase, but capped at 12% per year). The Board can levy special assessments for capital improvements with a 2/3 vote of members. A working capital fund equal to 2 months' assessment is paid at closing for each new Unit.
- Architectural review: Before building, altering, or making exterior changes to your Lot (including paint colors, fences, landscaping, mailboxes, signs, and even lawn ornaments), you must get written approval from the Declarant (developer) or the Architectural Review Committee (ARC). The Declarant has sole discretion to approve or deny plans, including for purely aesthetic reasons. A landscape plan may also be required.
- Use restrictions: Lots may only be used as shown in the Master Use Plan. No nuisances, no outside antennas/dish without permission, no mobile homes or trailers (except temporary sales trailers by developer). No outside clotheslines visible from the street. Garbage receptacles must be at the rear. No commercial use. Hunting and firearms are prohibited.
- Parking & vehicles: Each owner must provide paved off-street parking. On-street parking is generally not allowed, and parking on alleys is prohibited. No boats, campers, or trailers may be parked on streets or alleys; they must be garaged or screened. Inoperative vehicles and vehicles without current registration or inspection cannot be parked on any Lot, street, or other portion of the Properties.
- Leasing & rentals: Any lease of a Unit must be in writing and must state that it is subject to the Master Declaration, Articles, Bylaws, and rules of the Master Association. A lessee's failure to comply is a default under the lease. There is no restriction on an Owner's right to lease (for developed Units) except as may be provided in an applicable Supplementary Declaration. An unimproved Lot may not be leased.
- Pets & animals: Dogs, cats, or other household pets are allowed, but not for commercial purposes, and they must comply with all laws and any rules the Master Association adopts. No animal may be chained or tied to an inanimate object. Barking or other offensive sounds that disturb neighbors are prohibited unless the animal is under physical control outside the home. Livestock and poultry are not permitted.
- Enforcement & penalties: The Master Association, Declarant, or any Owner may enforce the covenants. Unpaid assessments accrue interest at 18% per year and a $25 late charge. The Association can foreclose on the lien or sue the owner personally. The Master Association also has the right (after notice and failure to correct) to enter a Lot to remedy unsafe or unsightly conditions and charge the owner.
