Whitney Village is a single-family home HOA in Holly Springs, NC. This document is the declaration of covenants, conditions, and restrictions that apply to homeowners and residents. It defines the association's authority, use of common areas, assessment obligations, and architectural control.
- What you own & maintain: You own your lot (the land) and the dwelling on it. The association owns and maintains the Common Area, which includes open space, street islands, storm water facilities, and some utilities. Association liability insurance must be at least $1,000,000.
- Leasing & rentals: Any lease or sublease must be in writing, with a minimum term of six months. The lease must include a clause binding the tenant to obey the HOA declaration and rules. A copy of the lease must be provided to the association.
- Architectural review: Exterior changes, new structures, fences, signs, or major landscaping require prior written approval. Plans must be submitted; if no decision is made within 30 days, approval is deemed given. The association may charge a review fee up to $75.
- Assessments & fees: Annual assessments start at a maximum of $60 per Class A lot (as of Jan 1, 2000). They can increase up to 10% per year without a vote; larger increases need 2/3 owner approval. Special assessments for capital improvements also require owner vote. Late fees and 18% annual interest apply after 30 days past due.
- Use of common area: Owners, residents, tenants, and guests have a right to use the Common Area for recreation and access, subject to association rules. The association may suspend use rights for up to 60 days for rule violations. Sale or transfer of Common Area requires 80% owner vote and approval of 75% of first mortgage holders.
- Enforcement & penalties: The association can fine owners for violations (fines become a lien on the lot), suspend voting rights, and use self-help (e.g., towing vehicles). The association may enter a lot to enforce rules. Prevailing party in legal actions recovers costs and attorney fees.
- Amendment & term: The declaration runs for 25 years from recording (1999), then auto-renews for 10‑year periods. Amendment requires 75% owner approval during the first 25 years, then 60% thereafter. FHA/VA approval required for certain actions while Class B lots exist.
