Patriot Bluffs is a planned community of single‑family homes in Fuquay‑Varina, NC, governed by a homeowners association (HOA). This document is the full set of covenants that bind all lot owners. It covers what you must maintain, what you can and cannot do on your property, and the association’s powers to collect fees and enforce rules.
- What you own & maintain: You own your lot and house. The association cuts the grass, maintains landscaping, sidewalks, and driveways on your lot that were installed by the developer (unless you build a fence or enclose an area — that’s your upkeep). You are responsible for windows, doors, screens, HVAC, and utility lines that are not publicly maintained.
- Assessments & fees: Every Class A lot pays an annual assessment. Through 2018 the maximum was $300/year, plus an extra $80/month for lots 1–52 for yard maintenance. The max can rise 10% each year automatically. A working capital fee of one‑sixth of the annual assessment is due at closing. The builder (Declarant) pays nothing while it owns lots that aren’t occupied.
- Architectural review: You must get written approval from the architectural committee before building, painting, fencing, adding a driveway, or making exterior changes. If the committee doesn’t act within 30 days, approval is assumed. Houses must be at least 2,000 square feet (excluding porch and garage).
- Pets: No livestock or poultry. You may keep up to 2 dogs and 2 cats (Rottweilers, pit bulls, and similar breeds are banned). Pets must be leashed outside, and you must clean up after them. The board can declare an animal a nuisance and require its removal.
- Leasing & rentals: There is no stated minimum lease term in this declaration, but the document refers to 'leased for rental purposes.' If your lot is rented, your voting rights are capped at 49% weight on association matters.
- Parking & vehicles: No street parking except in designated paved spots. No abandoned or inoperable vehicles. Boats, trailers, RVs, trucks over one ton, and commercial vehicles may not be parked or kept on any lot for more than 10 hours or overnight. The board can fine or tow violators.
- Signs: One ‘for sale’ or ‘for rent’ sign (up to 10 sq ft) is allowed. Political signs (up to 10 sq ft) can be displayed from 60 days before an election until 7 days after. No other signs are allowed without board approval.
- Use restrictions: Lots are for residential use only. No home businesses that create traffic, noise, or non‑residential signs. No commercial activity, no outdoor clotheslines, no furniture on porches. Garbage must be in the rear yard, not visible from the street.
