Treyburn Residential Owners Association (Durham, NC) is a master-planned residential community governed by master declaration covenants, conditions, and restrictions that bind all Owners of Residential Units (single-family, townhome, condominium, etc.) within this large community. This document establishes the association's structure, property rights, maintenance responsibilities, insurance requirements, architectural standards (including design guidelines referenced as Exhibit C), use restrictions, and assessment obligations. It applies to anyone who owns a residential lot or unit within the Treyburn community and to their tenants and occupants.
- What you own & maintain: You own your Residential Unit (lot and structure) and are responsible for its maintenance in a manner consistent with the 'Treyburn-Wide Standard.' The Association maintains the Common Area (shared land, landscaping, and improvements) and may assume maintenance for subdistricts or associations, funded by your assessments.
- Assessments & fees: Annual General Assessments are levied equally against all Residential Units (raw land or unbuilt lots pay half until certificate of occupancy or 2 years). The Association can also levy Special Assessments (requires 51% Class A vote plus Class B consent) and Subdistrict Assessments for specific areas. The lien for unpaid assessments is subordinate only to first mortgages, taxes, and Treyburn Association charges. Delinquent assessments accrue interest up to 18% per annum.
- Leasing & rentals: Leases must be for a term of at least six months. The Owner may assign the voting right to a lessee via written instrument. All occupants are bound by the same use restrictions that apply to Owners, and the Association can enforce against tenants.
- Pets: No more than two common household pets (dogs, cats) per Unit. Dogs must be leashed when outside and walked only in designated areas. No commercial breeding or keeping of animals, livestock, or poultry. The Association may remove pets that roam free, make objectionable noise, create a nuisance, or endanger health.
- Architectural review: All new construction must follow the Community Development Code and Land Use Standards (CDC-LUS) and be approved by the New Construction Committee (NCC). Modifications, additions, or alterations to existing Units require approval from the Modifications Committee (MC); plans not acted on within 45 days are deemed approved. Repainting in an originally approved color or rebuilding per original plans does not require approval. Exterior sculpture, fountains, flags, solar panels, and antennas all require prior written approval.
- Parking & vehicles: Vehicles must be parked only in garages or driveways (or designated spaces). Commercial vehicles, tractors, mobile homes, trailers, campers, boats, and boat trailers must be parked entirely inside a garage unless the Board permits otherwise. No garage may be altered to reduce its original parking capacity.
- Use restrictions: No signs without Board consent. No exterior antennas or satellite dishes without approval. No clotheslines. No above-ground pools. No firearms (including B-B guns). No tents, trailers, or temporary structures. No subdivision of a Unit without Board and Treyburn Association approval. All exterior lights (except seasonal Christmas decorations) require approval. No artificial vegetation on exteriors. No overhead utility lines permitted except temporary construction lines. No window air conditioning units without approval. No solar panels unless they are an integral and harmonious part of the design.
- Age restriction: This document does not impose an age restriction. The community is not designated as a 55+ or active-adult community.

- Amendments
- Before first sale, Declarant may amend unilaterally. After first sale, Declarant may amend only if still owns property on Exhibit B and no adverse effect on Owners. Otherwise, amendment requires affirmative vote of 75% of total votes of Ass (Article XIII, Section 2)
