This is the full declaration of covenants, conditions, and restrictions — essentially the rulebook that binds all owners, residents, tenants, and guests. It creates a homeowners association (The Bluffs at Magnolia Creek Owners Association Inc.) and is part of the larger Magnolia Creek master-planned community.
- What you own & maintain: You own your lot and the dwelling on it. The association maintains the exterior of your home (roof, siding, gutters, paint, sidewalks, driveways) plus the common areas, private streets, and all landscaping (including mowing). You are responsible for interior systems, windows, interior doors, plumbing/electrical/HVAC, patios/decks/stairs, watering your own landscaping, and sewer lines from the clean-out to the unit.
- Leasing & rentals: Leases must be for at least 90 days — no short-term or transient rentals allowed. You can rent only the entire lot (not a room). You must provide the association with the tenant's name, a copy of the lease, and certify the tenant received a copy of the governing documents. Renting does not relieve you from paying assessments. If the tenant seriously violates rules, the association can evict them, and you may be charged the legal costs.
- Parking & vehicles: No street parking allowed. Park in your garage whenever possible; otherwise, only in your driveway. No boats, trailers, recreational vehicles, campers, or commercial vehicles (with business advertising/equipment) may be parked or stored anywhere in the community, including on your lot. Government-issued vehicles and common family cars with small business logos may be exceptions.
- Pets: The declaration does not specify pet limits or types. Pets are governed by the association's rules and regulations, which are adopted separately by the board.
- Use restrictions & businesses: Lots are for single-family residential use only. No business, commercial, or manufacturing uses are allowed, but owners may conduct activities from home that don't conflict with zoning or burden traffic. - Fines & enforcement: The association can impose fines up to $100 per day for each day a violation continues after a 5-day cure period. It can also suspend voting rights and access to common facilities (except drainage and access rights). The association may enter your lot to fix violations at your cost if you don't correct them within 5 days of written notice.
