Panther Creek of Durham is a single-family home HOA in Durham, NC. As a homeowner, you own your lot and house; the association enforces architectural and use rules to maintain the neighborhood’s appearance and value. Buyers and residents must follow the covenants, which run with the land.
- Architectural review & appearance: No structure or exterior change (residence, fence, driveway, mailbox, pool, shed, satellite dish, etc.) may be built or altered without written approval from the Architectural Review Committee. Plans must be submitted; if the committee does not respond within 30 days, approval is deemed given. Houses must be detached single-family, no more than 2.5 stories plus attic.
- Lot use & subdivisions: Lots are for residential use only. No lot may be subdivided to reduce its area as shown on the recorded plat, though lots may be combined or lot lines adjusted with government approval as long as the total number of lots does not increase.
- Parking & vehicles: Motor vehicles and equipment must be stored in enclosed garages, not regularly parked in the open. No overnight parking on the roadway; owners must provide parking within their lot. Boats, trailers, campers, and tents are not allowed on any lot unless hidden from street view.
- Pets & animals: No livestock, poultry, or similar animals are allowed without the declarant's permission. A reasonable number of household pets is permitted if not raised commercially. Any outdoor pet enclosure must be in the rear yard and approved under the architectural review process.
- Signs: No commercial signs are allowed, except a single 'For Sale' or 'For Rent' sign no larger than 2 feet wide by 3 feet tall. Such temporary signs do not need to meet setback requirements.
- Prohibited activities & nuisances: Noxious, offensive, or loud activities are forbidden. Owners must avoid acts that could reasonably cause embarrassment, discomfort, annoyance, or nuisance to the neighborhood. Hobbies that create disorderly or unsightly conditions (e.g., assembling/disassembling vehicles) are not permitted on any lot.
- Utilities & easements: A 10-foot easement along rear or side lot lines is reserved for utilities (electric, gas, sewer, cable, telephone, drainage). Exposed above-ground fuel or water tanks are prohibited unless kept in a screened enclosure that is at least 1 foot taller than the tank and compatible with the house.
- Amendment & duration: These covenants run for 30 years from the January 2004 recording date, then auto-renew for two 10-year periods. Amendments require approval from 75% of lot owners and must be recorded in Durham County.
