This is a second amendment to the condominium declaration for Magnolia Condominium in Durham, NC. It does not contain the full set of rules for residents, but rather a specialized change that redefines what a 'unit' is for owners who each own an entire building.
- What this document doesn't cover: This amendment does not contain the full condominium rules about pets, leasing, guest policies, or association fees. It focuses only on ownership structure for the current single-building owners.
- What you own & maintain: When all units in a building are owned by one person, that owner is responsible for maintenance and repair of the entire building — including roof, foundation, porches, exterior surfaces, and connected structures. The common elements not serving only one building are still the association's responsibility.
- Insurance responsibility: The owner of each entire building must insure that building as one property, including all fixtures, built-in appliances, and mechanical systems. They must also get liability insurance for that building.
- Limited common elements: Parking areas, exterior grounds, decks, porches, balconies, patios, exterior doors and windows that serve a single building but are outside its walls are designated as limited common elements allocated exclusively to that building's owner.
- Current ownership structure: This amendment applies only while all units within a single building are owned by one owner. At the time of signing, Whitecoin LLC owns Building B and Catherine R. Dykes owns Buildings A and C.
