Latta Woods is a planned single‐family home community in Durham, NC, governed by a homeowners’ association (HOA). This document is the full Declaration of Covenants, Easements, Conditions and Restrictions (plus Bylaws) that applies to all owners and residents. It covers what you can and cannot do with your property, the HOA’s powers, and your financial obligations.
- What you own & maintain: You own your lot and any house/improvements on it. The HOA owns and maintains the Common Elements (open space, amenities, entrance monuments, etc.). You must maintain your lot to the “Community Standard” set by the Board, and the HOA can enter your lot to fix violations or protect common property.
- Leasing & rentals: No hotel, transient, or short‑term rental use. All leases must be in writing and for a term of at least six months. Roomer/boarder arrangements are not allowed. Owners must comply with the Declaration and rules when leasing.
- Pets & animals: No breeding, boarding, or commercial keeping of animals. Pets must be restrained and not roam free. Any pet that becomes a nuisance (as determined by the Board) may be prohibited. Owners must promptly remove pet waste from their lot and common areas.
- Vehicles & parking: No commercial vehicles, boats, trailers, campers, or mobile homes may be parked on streets or lots (except in an enclosed structure). Inoperable vehicles cannot be stored for more than seven days. The Board may impose fines or remove violating vehicles.
- Architectural review: All exterior changes – construction, fencing, paint, roofing, landscaping, etc. – need prior written approval from the Architectural Control Committee (ACC). The ACC can set design standards and grant variances. Chain‑link fencing is prohibited; above‑ground pools over 12 inches from grade are not allowed without ACC approval.
- Signs & antennae: Signs are severely limited: only one small real estate sign (≤6 sq ft), political signs, and marketing signs by the developer. Satellite dishes up to 39 inches are allowed but must comply with ACC visual guidelines. Other antennae need prior approval.
- Assessments & fees: Owners pay an Initial Contribution (1/6 of the current annual assessment), an Annual Assessment (first year $240/developed lot, $24/undeveloped), plus possible Special Assessments and Lot Assessments. Unpaid assessments incur 16% interest, late fees, and a lien on the lot after 30 days.
- HOA governance & voting: Before the “Turnover Date,” the developer controls the Board and has 10 votes per undeveloped lot. After turnover, each lot gets one vote. The Board can make and enforce rules, suspend voting/amenity access, and levy fines up to $100/day for violations. Owners can call a special meeting with 10% of votes.
